Terms & Conditions

1. Definitions

• Client: Any individual or business entity engaging KR Graphic Design for design services.

• KR Graphic Design: Refers to the freelance designer, Katty Rodrigues, located at 33 Cunningham Way, Leavesden, Watford, WD25 7NG, Hertfordshire, England.

• Project: The specific design work commissioned by the Client, as detailed in the agreed-upon proposal or contract.

• Deliverables: The final design files or other materials produced by KR Graphic Design as part of the Project.

• Content: Any text, images, or other materials provided by the Client for use in the Project.

2. Scope of Services

KR Graphic Design will provide design services as outlined in the individual Project proposal or contract. This may include, but is not limited to:

• Banners

• Stationery

• UX Design

• App & Web Design development

Any changes to the scope of the Project after the initial agreement will be subject to a revised proposal and adjusted fees.

3. Fees and Payment

• Fees: Detailed in the individual proposal or contract.

• Payment Terms: 20% upon invoice issuance (non-refundable, payable within 7 days), 30% after design approval, and 50% before final delivery.

• Payment Methods: Bank Transfer to KR Graphic Design account.

• Late Payments: May incur a 5% monthly interest charge.

• VAT: All fees are exclusive of VAT unless otherwise stated.

• Urgent Jobs: Additional charges may apply for urgent or emergency projects.

4. Suspension of Services for Non-Payment

Monthly retainer payments are due on the [1st] of each month. In the event that payment remains outstanding for more than seven (7) calendar days past the due date, all services—including content creation, scheduled posting, and community engagement—will be suspended immediately.

Services will resume only upon receipt of the full outstanding balance.

The Designer/Agency is not responsible for any loss of engagement or reach resulting from this service interruption.

5. Client Responsibilities

The Client is responsible for:

• Providing clear and concise project briefs and feedback.

• Supplying all necessary Content in a timely and usable format.

• Approving designs promptly at agreed-upon stages.

• Paying all invoices according to the agreed-upon payment terms.

6. Intellectual Property Rights

• KR Graphic Design retains ownership of all original design concepts and draft materials.

• Upon full payment, the Client receives a license to use the final Deliverables for the agreed-upon purpose.

• KR Graphic Design reserves the right to showcase the completed Project in their portfolio and marketing materials unless otherwise agreed in writing with the Client.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared during the course of the Project.

8. Revisions

Two rounds of revisions are included in the project fee. Additional revisions will be billed at an hourly rate of £45.

9. Project Timeline

• The estimated project timeline will be outlined in the individual proposal or contract.

• If the project is not completed within 3 months due to delays on the Client's part, the project may be closed, and funds retained.

10. Cancellation

• If the Client cancels the Project after signing the contract, the Client will be responsible for paying 10% of the project fee.

• KR Graphic Design reserves the right to cancel the Project if the Client breaches these terms and conditions.

11. Font Licensing

• Client projects may include the use of commercially licensed fonts. Unless otherwise agreed, the responsibility for purchasing and maintaining appropriate font licences rests with the client.

• KR Graphic Design may provide recommendations or links to purchase fonts required for the project. If a font is used within a logo or brand identity, the client must ensure the appropriate licence is purchased directly from the font provider.

• Design files may contain outlined text where necessary for printing or production purposes. KR Graphic Design is not responsible for any licensing restrictions associated with fonts once the final files are delivered.

12. Limitation of Liability

KR Graphic Design will not be liable for any indirect, incidental, or consequential damages arising from the use of the Deliverables. Our liability is limited to the total fees paid by the Client for the Project.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

14. Entire Agreement

These Terms and Conditions, together with the individual Project proposal or contract, constitute the entire agreement between the Client and KR Graphic Design for the provision of design services.
